These Terms of Service constitute a legally binding agreement between you ("Customer") and Montgomery Appliance Repair LLC ("Company", "we", "us", or "our"). By scheduling service, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree, do not use our services.
Definitions
- Service
- The appliance repair services provided by Montgomery Appliance Repair LLC as described in the service order.
- Customer
- The individual or entity scheduling and/or paying for the Service.
- Technician
- The Company's employee or subcontractor performing the Service.
- Appliance
- The equipment being serviced under this agreement.
Service Agreement
This Terms of Service Agreement ("Agreement") governs all services provided by A Plus Appliance & Refrigeration Repair LLC, a Texas limited liability company, with principal offices in Montgomery County, Texas.
Acceptance of Terms
By scheduling service, Customer agrees to:
- All terms and conditions herein
- Payment of all applicable fees
- Provision of a safe work environment for our Technicians
Scope of Services
We provide professional appliance repair services including but not limited to:
- Diagnosis of appliance malfunctions
- Repair or replacement of defective components
- Preventive maintenance services
- Emergency repair services (when available)
Service Appointments
Scheduling
- Service appointments are scheduled based on availability in our Montgomery County service area
- We provide a 2-hour service window for Technician arrival
- Same-day service may be available for certain critical repairs
Cancellation Policy
- 24-hour notice: Required for cancellation without fee
- Late cancellation: Less than 24 hours notice incurs a $75 service charge
- No-show: Customer will be charged $100 or 25% of estimated repair cost, whichever is greater
Payment Terms
- Payment is due in full upon completion of service
- We accept Visa, MasterCard, American Express, Discover, cash, and checks
- A $50 fee will be charged for returned checks
- Diagnostic fees range from $75-$150 depending on appliance type and location
- All prices subject to change without notice
Warranty & Guarantees
Parts Warranty
- All replacement parts include manufacturer warranty (typically 90 days to 1 year)
- Original parts receipts provided for warranty claims
- Warranty valid only when installed by our Technicians
Labor Guarantee
- 30-day guarantee on all repair labor
- Does not cover subsequent unrelated failures, misuse, or acts of nature
- Void if appliance is moved or serviced by others
Liability Limitations
IN NO EVENT SHALL MONTGOMERY APPLIANCE REPAIR LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, FOOD SPOILAGE, OR PROPERTY DAMAGE ARISING FROM OR RELATED TO OUR SERVICES.
- Maximum liability limited to the amount paid for the specific service in question
- Not responsible for pre-existing conditions or concealed damages
- Customer must disclose any known hazards (gas leaks, electrical issues, etc.)
- Not responsible for appliances with manufacturer recalls or known defects
Customer Responsibilities
- Provide safe, unobstructed access to appliances
- Disclose all pets and safety concerns prior to service
- Secure children and pets during service visits
- Empty dishwashers and clear surfaces before service
- Ensure proper electrical, gas, and water connections
Emergency Services
- After-hours services available for critical failures only
- Additional 35% service charge applies for emergency calls (after 6pm or weekends)
- Limited to Montgomery County and immediate surrounding areas
- Availability not guaranteed
Service Area
Our standard service area includes Montgomery County and surrounding communities:
- Montgomery
- Conroe
- The Woodlands
- Magnolia
- Willis
- Spring
- Outlying areas may incur additional travel fees
Intellectual Property
All diagnostic methods, repair techniques, and business processes are proprietary property of Montgomery Appliance Repair LLC. Unauthorized use or disclosure is prohibited.
Dispute Resolution
- Any disputes shall be resolved through mediation in Montgomery County, TX
- If mediation fails, disputes will be resolved through binding arbitration
- Texas law shall govern this Agreement
- Customer waives right to class action lawsuits
Changes to Terms
We reserve the right to modify these terms at any time. Current terms will be posted on our website. Continued use of services constitutes acceptance of modified terms.
